Cutting hours when renting/contracts

My nail girl is amazing at her job and has brought in a lot of regular happy clients but she's always been a pain with paying when it's quiet. She will see the diary is quiet on x day and decide to have the day off (without telling me) but then refuse to pay rent for that day unless I literally have a full blown arguement over it. She's now had enough of the argueing and just decided to cut her days down to 3 days until it's busier.. She's had a lot of time off recently so maybe that's why she's quiet atm.

None of my lot have contracts as I've taken over the business recently in the last month and one was never set up, but all this has made me decide to do one for each person who rents now.

I have a few questions.

Everyone started at different months do I wait till their first year is up (some will be jan others March and June next year) and then do contract from then, or just do it asap for everyone?

The way the rent was set was per day not per week. Ie the nail girl for example has the whole nail area pays £100 a week, works 5 days so she she's it at £20 a day so if she's off a day she only gives £80. The same for beautician etc. Can I now change it to state it's £x a week and days off don't matter you still pay up, or is it too late as they been there so long already?

The nail girl had always paid her rent at end of week for some reason but everyone else pays on the first day. Can I change this for her now? I think as she does her work then pays its easier for her to get away with things as if she quits I've lost and she's got a free week of work

Any other advice on contracts would be great.

Also I feel I should rent out the table the days she's off as tbh we can fill a whole week usually should I get a second table and squash them in or tell her from now on her table will be shared and she'll now have to remove her stuff when she's not in.
 
That's a really tricky one. I can see why someone would rather have the day off on a quiet day and not pay for the privilege of making a potential loss that day (sometimes a day off feels more valuable than a day of loss because not everyone wants to push for more clients because part time suits some people).

On the other hand her days off are making your income unstable so that's not positive either.

Not sure what to suggest but can empathise with both sides of the situation.
 
If she wanted to go part time I can accept that a little more but she's saying soon as its busy again she will up for days again so she's having her cake and eating it. When she's back to back all day making hundreds of pounds I don't ask for more than her £20 rent for that day so I feel I shouldn't have to lose out always.

I've just come into salon and realised she's booked today off again so yet again another day I'm not going to get rent for, yet I'm sure I'll have alot of clients wanting her today. She's been having so many days off the past month that I feel she's making herself quiet as we are constantly saying "sorry she's off again can I book you another day" people will soon go elsewhere to someone more reliable.
 
To be honest you need to get set days out of her in writing ( so she pays regardless whether she has clients or not on those days she is ret the space) or she leaves and you get someone more reliable in.

Really, I don't think she is compatible to the way you run your business and would suit working mobile or have a her own home salon were she can do what she wants
 
All self employed therapists have the right to book out any time they want without asking your permission BUT they still have to pay the rent.

So if she pays daily rent then she owes for the day even if she'd booked it off.

I would say you need to get contracts drawn up for all your self employed staff asap (& employed staff if you have any). You should have given them contracts from the day you took over, how long they have been there before you took over has no relevance.

Remember these therapists are renting from you so your just their landlord but they do have to pay their rent on the agreed days/weeks and at the agreed time (so if you want to state payment is due weekly & 1 week in advance then you can as your the new boss - but be prepared for them to say they don't want to sign it & want to leave) you can also choose to rent out the nail space to someone else on the therapists days off if you want to but that can get awkward.

I'm in the process of getting the contract drawn up for my new business.

I was quite suppressed on how many things I had not thought that were suggested to be included.

I have also been told of a few things I cannot control, which could have got me in trouble at some time, should I have included in the contract.

It's costing nearly £1000 but I feel it's impotant to keep me protected from the tenants and tax people.

I would suggest getting contracts drawn up, you have took over the business you should choose how much they pay aswell at a set rate, why not sit them all down and ask would they rather rent per day (set days) so you can rent the nail bar or rooms out on the other days theres no reason you should be making a loss, or if they want to rent per week and its theres all week whether they are there or not. I would say if they want to rent per day make it for example £25 per day but if they rent per week make it £100 a week so its a bit cheaper for them and will hopefully encorage them to work the week and you dont have to take someone else on to rent. I would always get the money a week ahead aswell then they have paid and you dont have any trouble getting it out of them.

I hope that all makes sense. Although the nail tech does rent the space it is her business sometimes clients dont understand that and it can reflect bad on you. I'd imagine from what you have said ur nail tech will rent per day so that gives u the option to look for someone else to rent on the days she isnt there. Good luck but defo get contracts drawn up, have a wee meeting and speak to everyone together :)

Ok so whilst your in the process of getting contracts drawn up, i understand this can take a while, its time to be reading the riot act.

Set a weekly amount for each of the girls and this covers them for that week. They can then choose what days they want to work etc.

Also everyone pays on the same day so if you want it start of the week then say it needs to be first day of YOUR week not theirs. So if your books are sun-sat and theirs is mon-sun they pay you on the sunday.

If anyone then says they want to be part time you then have two options. Remain the set price and dont rent to anyone else or give a set daily rate for set days then rent out the other days.
