Am I self employed or employed?

Hi geeks,
Im new here, need a bit of advice please?!
I am a nail technician of 16 years and worked in a salon employed for the past 15 years.

I have recently left said salon and started a new job elsewhere!

In this new job, my manager has said i am employed,i get pay slips and a monthly wage, but i am not paid by the hour! It is 60/40split to her(she supplies all products)

Am i employed or self employed?

% split would apply if you are self employed. If you are employed you should be paid an hourly rate that must be at least the nmw. So check first that you are at least getting that and ensure your payslips show tax and ni contributions. I got stung years back as a junior. I was getting payslips but no figures on for tax or ni. About a year after I left I discovered I owed ni payments which from the time I worked at that salon. They hadn't been paying it though they were deducting from me.
 
Does she tell you when to start and when to finish work? Do you get holiday pay? Can you choose not to work if you don't want to?

Looking at it, I'd say you're employed. Definitely check your payslips for your tax code, ni number and deductions. She will also be responsible for offering you a workplace pension.

She does tell me when to start and finish, all aspects sounds like im employed i suppose, but the 60/40 threw me lol!
 
She may be trying to swing it. I would check that your tax etc is being paid and work out if you're getting minimum wage. If not shes acting illegally. She'll definitely be liable for your workplace pension [emoji85]
