I struggle to understand why they go after the poor misled therapist rather than these companies that are selling the equipment. I suppose it's the end user - ie the therapist that's in the wrong.
This is the correct answer.
Take Megawhite for example.
They were originally known as Dentawhite and did teeth whitening themselves.
They were taken to court in 2012 and lost (had to refund patients and a franchisee). When the GDC started looking they renamed themselves The Teeth Whitening Shop and focused on Groupon.
Groupon and the deal sites banned them as the GDC informed them it was illegal.
They then renamed themselves Megawhite and, this is the important part, STOPPED DOING IT THEMSELVES.
Watch the stand next time you go - the owners NEVER help a customer to the light, they have a PR girl hired for the day do it.
They train up salon owners to do the treatment and TAKE THE LEGAL LIABILITY.
