Hi Geeks, I have a stylist that is contracted to 23 hrs per week,this stylist is continually asking to either leave work early or come in work later, probably doing her own clients. When I pay holiday pay do I take into account how many days she has gone on to a shorter day or do I still have to pay her what she is contracted out as. Another problem is that she has 2 days left for the rest of the year which runs Jan to Dec, holidays include Christmas and Boxing Day which she wants to take in September. My problem is if she takes these days and has no holidays left and leaves before Christmas how would I get the hol pay back? Sorry for the long questions.
 
You need to take into account the contracted hours when calculating holidays. This will be on a pro rata basis as she is part time. You will also need to calculate and bank holidays pro rata. For example is she would usually work 2 days per week then she is entitled to 2/5th’s of the bank holidays and 2/5th’s of the annual leave you would pay a full timer for.

Should she leave before the end of the holiday year and has over spent on the amount of holidays she would be entitled to, you would deduct this from her final salary just as if she had not used all her entitlement, you would pay it to her. I hold this helps.

It would be worth addressing the issue of her leaving early and coming in late though as this may have a negative impact on other staff. You are paying her for it after all.
