Ladies! I need help/advise. I have to be very, very careful with what I say due to the nature of the issue.

So I work full time, have been in the company since 09/13. I found out I was pregnant in 02/14 and notified my team leader (in writing) by 03/14 (10 weeks gone) this was passed to HR in the same month.

According to gov guidelines they had to contact me within 28 days of me giving notice of my pregnancy and maternity start date. They did not provide this. I've requested details a further 3 times (all in writing) about the maternity policy/procedures in our place of work. HR didn't understand what I wanted too know. They requested my MATB1 form 2 weeks before I was even allowed to have it.

I have since given (in writing) my MATB1 form and my new revised date of maternity leave. Everything I have done has been in accordance with the gov guidelines. Now they only passed my probationary period 2 weeks ago.

Now, am I right to feel that they may not have provided me with the correct information or delayed providing it, because I was in probation and that it's possibly discrimination? My friend works in HR (different company) and is very adamant that my company have not done the right thing.

I have emailed them (as advised by my friend) that they haven't done as they should. Though I don't expect a response.

Long one I know! What do you guys think? Should I go to CAB? Should I be more concerned? Xx

Sorry honey I'm not sure I understand. Discrimination would be if they did not take you on after your probation because you're pregnant, which they've obviously not done.

Who knows why they didn't provide you with your documentation. It could simply be sloppy work or lack of knowledge on their part.

What is it that you want the outcome of this to be honey? Personally, they've continued your service (taken you on after probation) and provided you with correct documentation now, so no I wouldn't call this discrimination.

Sorry chick, maybe I've misunderstood you, but I don't really see a problem as such.

What was your initial probation period? When should it have ended?

I thought the same as Happyfeet but didn't want to reply as I was afraid I was going wrong somewhere along the line.

So as far as I can tell you got all the forms requested-some early some late. But you don't need anything else from HR?

That's the thing, they've not provided me with any information about the maternity policy or procedures in our office. They had to within 28 days as per the gov guidelines. I have a suspicion they didn't give me or discuss the maternity stuff because I was in probation. Though that's not a good enough excuse not to do it. Even if they were going to dismiss me. Does that make sense? X

Edit- I've provided them with everything as per gov guidelines, they haven't done anything at all. Literally nothing, no risk assessments, no confirmation of maternity leave, absolutely nothing.

Link to the gov guidelines just for clarification.

I understand that you guys may not be able to help or advise, I'm just really concerned about this and don't want to find out I've been treated unfairly or incorrectly, when I could have a chance to rectify it. Xx

Over here I'm sure it's down to your line manager to go through risk assessment and things like that? Maybe talk to your manager and say no one has said anything about it to you?

If you have a contract of employment (which I'm assuming you do) is the maternity policy and procedures not in there lovey? If it is maybe that's why they are unsure what you mean.

They should be doing a risk assessment for you, absolutely, it could have been escalated to the line manager or they're a bit slow in doing so, which isn't on but doesn't mean discrimination.

Have you actually spoken to HR or is it just emails? Sometimes a quick call can sort it out quicker.

I don't think you'd ever get to the bottom of why they didn't send you the info as required if indeed it was due to probation. My employer with my first child followed the correct procedures even though I was on probation so you're quite right it should have been done. If they didn't do it because you were on probation I don't think anyone would admit to it and I don't see how you'd prove it lovey.

whatever your suspicions, at this stage I think you have to take the positives, you've worked hard and they've kept you on, so they've not discriminated against you for being pregnant. Now is the time to contact, id suggest call, HR and ask when they are doing your risk assessments. To be honest whilst risk assessments are there to keep you and bubs safe and well, a company is just plain stupid not doing them and covering their own backs. Have a wee look through your contract and if their pregnancy policies and procedures aren't in there let them know. I'm not entirely sure what would be in them besides telling you they will be doing risk assessments and the info they've given you already, most likely thinking back it may tell you what to do in the event of returning and such like.

I understand you're feeling a bit jittery honey, but try to relax. You've completed and surpassed your probation, you've got a maternity start date and you've just got to chase the final bits. As I said previously, I don't think they've discriminated but if you're concerned just keep your eyes and ears open. As it stands at the moment they've only been late with providing you with a start date, risk assessments and paper work(if not in your contract)- hold on to the fact that you are a fully fledged employee now and put it down to them being a bit of a shoddy HR department. Xx
